Worker sues over trip over pallet

A Mississippi man who claims he tripped over an empty pallet while working has filed suit against his employer.

Royce Thompson claims he tripped and fell over an empty pallet left in the loading area of a dock where he was working for A. Schulman Inc. on Feb. 19, 2008.

As a result of the fall, Thompson sustained physical pain, suffering and mental anguish, lost his earning capacity, suffered physical impairment and incurred medical costs, according to the complaint filed Nov. 2 in Jefferson County District Court.

At the time of the occurrence, A. Schulman did not have workers compensation insurance, the suit states.

The company negligently failed to protect Thompson from a dangerous condition and failed to warn of the existence of the danger, the complaint says.

Thompson is seeking an unspecified judgment, plus pre-judgment interest, costs and other relief to which he may be entitled.

Tom Oxford of Waldman Smallwood in Beaumont will be representing him.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
