Dec. 7

  • Judy and Jimmie Harrington vs. Traylor Shmiker and Venetia Hawkins

    PA - Travis McCall, J - Bob Wortham

    On Dec. 17, 2007, the plaintiffs were struck by Shmiker, who was driving a vehicle belonging to Hawkins.

    The suit does not state how or where the incident occurred.

    The plaintiffs are suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

  • Kevin Savoie vs. Chelsea Hubert

    PA - Jeffrey Befort, J - Gary Sanderson

    Earlier this year, Chelsea Hubert veered into oncoming traffic and struck Kevin Savoie while he was out riding his motorcycle.

    On Dec. 7, Savoie filed suit against Hubert, along with the owners of the vehicle she was driving, Joshua and Carol Thomas, in Jefferson County District Court.

    According to his suit, on March 7 Savoie was traveling west on F.M. 1960 in Harris County when Hubert crossed the median into oncoming traffic and struck him, "causing him to be ejected from his motorcycle."

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

  • Andres Martinez et al vs. Texas Windstorm Insurance Association

    PA - Steve Mostyn, J - Milton Shuffield

    The plaintiff is suing the insurance company and several of its agents for denying at least a portion of the plaintiff's Hurricane Ike policy claim.

    The plaintiff alleges the defendant is guilty of several Texas Insurance Code violations and of violating the DTPA.

    The plaintiff is suing for actual and consequential damages, plus attorney's fees.

  • Dawn Singleton vs. Darryl Harris

    PA - Craig Lewis, J - Milton Shuffield

    A local woman has filed suit against the Women's Center of Beaumont and the surgeon who operated on her.

    Dawn Singleton filed the suit against Dr. Darryl Harris and the Women's Center.

    According to her suit, on Sept. 25, 2007, Dr. Harris operated on Singleton at Memorial Hermann Baptist Hospital in Beaumont.

    However, the suit does not state what king of surgery she underwent and how the defendants were negligent in their care of her.

    The suit only accuses Dr. Harris of breaching the standard of care and says "when this case is tried, the evidence will show that Dr. Harris was negligent in his treatment."

    Singleton is suing for past and future mental anguish, medical expenses, lost wages and impairment, plus all court costs and attorney's fees.

  • Mark Kloesel vs. Huntsman LLC et al

    PA - Mark D. Vancleave, J - Donald Floyd

    A Harris County man has filed suit against his former employer and supervisor, alleging his supervisor vented a flammable gas into his face during training.

    According to a personal injury suit, plaintiff Mark Kloesel claims he began working for defendant Huntsman Port Neches Performance Products in August 2008.

    During a training session at Huntsman on Aug. 14, 2008, Kloesel alleges defendant John Dellan Provost intentionally vented ethylene oxide into Kloesel's face, saying Kloesel needed to know what the gas smelled like.

    Because of the incident, Kloesel claims he incurred physical pain, suffering, mental anguish and medical costs and lost his future wage earning capacity.

  • Priscilla Kujawski vs. Marjorie Carter

    The plaintiff claims the defendant caused an automobile collision on Dowlen Road in Beaumont.

    The suit does not state when the incident or how the incident occurred, or even what damages the plaintiff is seeking.

  • Dedra Denise Champs vs. Morris Bell-Zamora

    PA - John Parsons, J - Bob Wortham

    On Nov. 2, 2008, the plaintiff was traveling north on the Eastex Freeway when the defendant rear-ended her after she slowed down because of traffic.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

  • Phyllis Hancock vs. Assisted Living Concepts

    PA - Barrett Lindsay, J - Gary Sanderson

    A woman claims Assisted Living Concepts refused to mediate or arbitrate a case she filed against it for wrongful termination.

    Phyllis Hancock filed a lawsuit against Assisted Living Concepts.

    Hancock claims she slipped on a mat while working at Assisted Living Concepts on April 18, 2005, causing injuries to her right knee.

    "The injury temporarily impaired Plaintiff's ability to stand for long periods of time," the suit states. "Plaintiff's inability to stand for long periods of time interfered with her ability to perform her work duties. While in the process of getting treatment for her injury, Plaintiff was terminated from her employment."

    Since her termination, Hancock claims she has repeatedly attempted to engage Assisted Living Concepts in its own dispute resolution process. However, Assisted Living Concepts has refused to comply with its own obligation to mediate and, if necessary, arbitrate Hancock's case, the suit states.

  • Terrie Cimino vs. Hazel Hamlin

    On Dec. 20, 2008, the defendant was exiting a private driveway when she struck a vehicle the plaintiff was riding in.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

  • Texas Windstorm Insurance Association vs. MRCO et al

    PA - Anthony Malley III, J - Bob Wortham

    Since Hurricane Ike struck in 2008, thousands of lawsuits against windstorm insurers have filtered into Texas Gulf Coast courthouses.

    But on Monday, the Texas Windstorm Insurance Association struck back with a suit of its own, filing a petition against the contractors who "improperly" and "fraudulently" certified the MCM Elegante Hotel in Beaumont to TWIA regulations.

    The suit names MRCO Inc., Titan Services and Hospitality Construction Services as defendants.

    According to the petition, the MCM Elegante Hotel made a claim for insurance coverage after Ike's wind blasts pummeled the Golden Triangle.

    However, in its suit, TWIA contends the hotel was not built to the appropriate regulations and guidelines "pursuant to the windstorm contract and TWIA rules."

    The plaintiff is seeking actual damages
