GALVESTON - A family embroiled in a credit card dispute submitted a joint motion for continuance into the son's lawsuit.
St. Louis, Mo., resident Matthew G. McMahon and his parents, Eugene V. McMahon of Webster and Darlene L. Marzouk of Dickinson, filed a five-page document Nov. 22 before the Galveston County Court at Law No. 2, pleading for a change in the current trial setting of Dec. 5, 2011.
"This case is not ready for trial for the reason that the parties have not yet attended mediation," the motion says.
Matthew G. McMahon alleges his parents owe him about $26,000 in credit card charges in a lawsuit filed last Feb. 14.
According to the younger McMahon, the divorced couple incurred numerous charges for which they refuse to pay.
They went into debt, including property taxes, during the course of their marriage, the suit claims.
Eugene V. McMahon and Marzouk approached the plaintiff about using his four separate low-interest credit cards.
He consented, and the parties entered into an agreement in which the parents promised to pay all charges and indemnify the complainant, according to the complaint.
The original petition shows two Citi cards accumulated combined charges of $13,000 while $10,000 was put on a pair of Bank of America cards, stating their account holder has never been compensated.
Eugene V. McMahon and his ex-wife each filed formal answers to the allegations.
Galveston County Court at Law No. 2 Judge Barbara Roberts issued an order switching the trial date to Jan. 17, 2012, the same day the motion was entered.
