Port Arthur woman sues driver who struck her

A Port Arthur woman claims she sustained physical pain and suffering after a driver struck her.

Silvia A. Mercado filed a lawsuit Jan. 27 in Jefferson County District Court against Jose A. Herrera.

Mercado claims Herrera hit her on Aug. 16, 2009, after he failed to control his speed, failed to maintain a proper lookout, failed to timely apply his brakes, failed to drive in a safe manner and failed to maintain control of his vehicle.

Because of the accident, Mercado experienced mental anguish, incurred medical costs, suffered physical impairment and lost wages, according to the complaint.

Mercado seeks an unspecified judgment, plus pre- and post-judgment interest, costs and other relief the court deems just.

Jon B. Burmeister of Moore Landrey in Beaumont will be representing her.

The case has been assigned to Judge Bob Wortham, 58th District Court.
