Woman sues driver, car owner after collision

A Jefferson County woman claims she incurred medical expenses after a driver failed to stop and yield the right-of-way to her.

Sherron W. Gallier filed a lawsuit Feb. 16 in Jefferson County District Court against Adrian Gonzalez and Griselda Sanchez.

Gallier claims she drove in Jefferson County on Sept. 29, 2008, when Gonzalez, who drove a vehicle Sanchez owned, collided with her.

Because of the accident, Gallier incurred medical costs; experienced pain, suffering, mental anguish and physical impairment and lost earnings, according to the complaint. In addition, her automobile sustained excessive damage, the suit states.

Gallier blames Gonzalez for causing the accident, saying he failed to keep a proper lookout, failed to maintain control of the vehicle he drove, drove too fast, failed to timely apply his brakes to avoid a collision, failed to exercise ordinary care, failed to turn his vehicle to avoid a collision, failed to keep a proper distance between himself and Gallier and failed to drive within a single lane. In addition, he failed to stop and yield the right-of-way, failed to change lanes only when it became safe to do so, failed to stop at an intersection in obedience of a traffic control signal and failed to enter the intersection only when it was safe to do so, the suit states.

Sanchez should never have lent her vehicle to Gonzalez, who she should have known to be an unlicensed, reckless and incompetent driver, the complaint says.

In her complaint, Gallier seeks a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus pre- and post-judgment interest and other relief to which she may be entitled.

B. Adam Terrell of Weller, Green, Toups and Terrell of Beaumont will be representing her.

The case has been assigned to Judge Gary Sandeson, 60th District Court.
