Passenger involved in rear-end collision files lawsuit

TYLER -- Traveling down the interstate in southeast Texas, a Louisiana resident was involved in a rear-end collision when another driver was unable to control the speed of his vehicle.

Yvette Riley filed suit against Georgia resident Enrique C. Patino on October 6, 2009, in the Eastern District of Louisiana. The defendant removed the case to the federal court, Eastern District of Texas, Tyler Division on February 23.

Riding as a passenger in a vehicle driven by William Thurman, Riley states they were in the outside lane of Interstate 10 traveling eastbound, when the vehicle driven by Patino "suddenly and without warning" struck the rear passenger side of the Thurman vehicle.

Riley believes Patino is negligent for failing to control his speed, acting in a reckless and imprudent manner, and failing to prevent an accident.

According to court records, Patino received a traffic citation for failing to control speed.

The plaintiff is seeking more than $75,000 in damages for past, present, and future pain and suffering, lost wages, loss of enjoyment of life, emotional anguish, medical expenses, and for shock and trauma.

New Orleans attorney David W. Bernberg is representing the plaintiff.

U.S. District Judge Michael H. Schneider will preside over the litigation.
