Worker claims scaffold unsecured, sues employer

GALVESTON - A Galveston man claims he fell from some scaffolding that his employer reportedly failed to secure, recent court documents say.

In a lawsuit against Solera Construction LLC and supervisor Horacio Hernandez, Valentin Garcia alleges that on Feb. 16 Hernandez instructed him to climb onto a scaffold to perform some work at a Chinese buffet restaurant in Dickinson.

According to the original complaint filed April 8 in Galveston County District Court, the plaintiff states that the scaffolding suddenly collapsed while he stood on it. Garcia claims he sustained serious, painful, and disabling personal injuries.

The suit faults the defendants for failing to give Garcia advanced warning and neglecting to provide him with the necessary safety devices.

Garcia seeks damages for physical pain and suffering, mental anguish, lost earnings and medical expenses.

He is represented by Houston attorney Joseph R. Corteguera.

Galveston County 56th District Court Judge Lonnie Cox is presiding over the case.
