Arkansas resident sues truck driver and employer for interstate collision

An Arkansas resident is claiming a Shira Truck Leasing employee rear-ended her so hard that he sent her spinning out on Interstate 10.

Latosha Berry filed suit against Shira and Shira truck driver Montwin Delton on April 16 in Orange County District Court.

In her suit, Berry says she was stopped at an I-10 entrance ramp when Delton "hit with such force from behind that it shoved her from the on-ramp up onto the highway into on-coming traffic, spinning (her vehicle) until hitting an embankment."

Berry was taken by ambulance from the scene to St. Elizabeth Hospital.

The suit does not say when the incident occurred.

Berry alleges Delton negligently failed to maintain a proper lookout and Shira negligently hired and trained him.

She is suing for past and future medical expenses, mental anguish and lost wages, plus exemplary damages.

She is represented by attorney Myra Gregory.

The case has been assigned to Judge Pat Clark, 128th Judicial District.
