Local man alleges termination due to workers' comp claim

An Orange County man claims his former employer wrongly terminated him after he filed for workers' compensation benefits.

Darin Linscomb filed a complaint April 22 in Jefferson County District Court against KDR Supply.

Linscomb claims he sought workers' compensation benefits after he sustained injuries while working for the defendant. In his complaint, Linscomb does not specify how or when he sustained the injuries.

Because of Linscomb's workers' compensation claim, KDR Supply terminated him, according to the complaint.

Linscomb's termination and injuries resulted in physical pain and suffering, mental anguish with physical manifestation, lost wages and a loss of earning capacity, the suit states.

In his complaint, Linscomb seeks an unspecified judgment, plus interest at the legal rate, costs and other relief the court deems just.

John S. Morgan of Harris, Duesler and Hatfield in Beaumont will be representing him.

The case has been assigned to Judge Milton Shuffield, 136th District Court.
