Suit filed after rear-end collision

A Pottstown man has filed suit against the driver who he claims rear-ended his vehicle.

Kenneth Lazard claims he was driving north on U.S. 69 in Beaumont on May 26, 2009, when defendant Randall Pues rear-ended him near the Delaware Street exit.

Because of the collision, Lazard incurred medical costs; experienced physical pain, suffering and physical impairment; lost his earnings and his earning capacity; and suffered mental anguish, according to the complaint.

Pues negligently failed to keep a proper lookout for Lazard's safety, failed to turn his vehicle to the right or left to avoid a collision, failed to maintain a safe distance between his vehicle and Lazard's, failed to keep the same distance a person using ordinary care would have done and failed to apply his brakes in a timely manner, the suit states.

In his complaint, Lazard is seeking a judgment within the jurisdictional limits of Jefferson County District Court, plus pre-judgment interest at the maximum rate allowed by law, post-judgment interest at the legal rate, costs and other relief to which he may be entitled.

Brett S. Thomas of Beaumont will be representing him.

The case has been assigned to Judge Gary Sanderson, 58th District Court.
