Verizon sues excavators over damage to transmission cables

GALVESTON � Verizon is suing The Cherry Companies for approximately $66,000 over damaged transmission cables.

Court records state that on May 19, 2008, The Cherry Companies was using heavy equipment to excavate at the intersection of Minnesota Street and Highway 517 in Dickinson when Verizon cables were damaged.

According to a suit filed May 6 in Galveston County District Court, the plaintiff accuses The Cherry Companies of failing to keep a careful lookout and failing to proceed in a safe and reasonable manner.

Verizon believes that the defendant also committed trespassing.

Hersche, Hayward, Drakeley & Urbach PC of Addison is representing the plaintiff.

The case has been assigned to Galveston County 212th District Court Judge Susan Criss.
