Two years ago, Ronald Robison was a passenger in a vehicle when the driver began coughing heavily, causing him to run off the road and strike a tree.
Robison filed suit against Marvin Block on May 4 in Orange County District Court, alleging he should have pulled over during his "coughing spell."
In his suit, Robison says he was injured on Oct. 15, 2008, when "Block left the roadway and struck a tree."
"Defendant was negligent ... in failing to pull his vehicle off the road while he was having a coughing spell," the suit states.
He is suing for past and future mental anguish, medical expenses and lost wages, plus all court costs.
The plaintiff is represented by attorney Sandee Hart.
The case has been assigned to Judge Pat Clark, 128th Judicial District.
