Tree trimmer injured by chain saw sues park owners

GALVESTON - A Uvalde County man who fell while he was trimming trees in a Uvalde park is suing the owners of the park in Galveston County District Court.

Jose Aguilar's personal injury lawsuit against Edward W. Poole of League City, Michael A. Poole of Austin, their businesses and Cherry Bluff Park claims the plaintiff slipped off a tree branch on May 21, 2008, while he was performing trimming services.

A plastic rope the defendants supplied Aguilar as a safety device failed to secure him, the original complaint, which was filed May 20 in Galveston County District Court, states.

The plaintiff states that the chainsaw he was using also fell and cut portions of his left wrist and hand.

Consequently, Aguilar seeks damages for physical pain, mental anguish, and medical expenses as well as a jury trial.

He is represented by The Law Offices of David McQuade Leibowitz, P.C. of San Antonio.

The case has been assigned to Galveston County 10th District Court Judge David Garner.
