La Marque ISD board accused of violating Open Meetings Act

GALVESTON - Two La Marque residents claim the city's public school district violated the Texas Open Meetings Act during a recent meeting of the board of trustees.

Joe Compian and Edna Marie Jones-Courville's lawsuit asks Galveston County 10th District Court Judge David Garner to prevent the La Marque Independent School District from "taking any acts to effectuate any vote taken in the May 13, 2010, meeting."

The suit was filed May 24 in Galveston County District Court.

Compian and Jones-Courville argue that during the meeting, LMISD allowed a former board member to vote, did not provide sufficient time for the public to speak and awarded a contract without bidding.

"Under Texas law, a violation of the Texas Open Meetings laws voids the acts of the governmental entity," the original petition says.

Consequently, the plaintiffs seek unspecified monetary damages.

Attorney Anthony P. Griffin of Galveston is representing Compian and Jones-Courville.
