Nancy Gutierrez's lawsuit is centered around the events of March 1, 2025, when her son, Miguel Gonzalez Jr., was fatally shot at the Willow Green apartment complex in Houston. According to the petition, Gonzalez was at the playground within the supposedly secure gated community when he was caught in gunfire during a gang initiation. Gutierrez accuses Dalcor and Orion of failing to maintain working security gates and neglecting to provide adequate security personnel despite previous violent incidents on the premises. "Defendants knew or should have known of the dangerous condition on their Premises," asserts Gutierrez in her filing.

The plaintiff seeks over $1 million in damages for what she describes as gross negligence by the defendants. She claims that their failure to address known hazards directly led to her son's untimely death. The lawsuit outlines several breaches of duty by Dalcor and Orion, including not maintaining functional gates and lacking proper security protocols and personnel. Gutierrez argues that these failures represent a disregard for resident safety and requests exemplary damages under Texas law.
