Two Port Arthur residents claim they sustained multiple injuries after a driver rear-ended them.
Clarence and Marcella Abraham claim they traveled on Main Avenue in Port Arthur on June 9, 2008, when defendant Margarita Avalos, who drove a vehicle insured by Juan Avalos, failed to control her speed and slammed into the rear of their vehicle.
Because of the collision, Clarence Abraham suffered headaches and neck, upper back and knee pain and incurred property damages while Marcella Abraham suffered headaches and neck and right wrist pain, according to the complaint filed June 4 in Jefferson County District Court. Both plaintiffs incurred medical costs; lost earnings and their earning capacity; and experienced physical impairment, physical pain and mental anguish, the suit states.
They blame Avalos for failing to keep a proper lookout, for failing to timely apply her brakes to avoid the collision and for failing to control her speed to avoid a collision, the complaint says.
In their complaint, the Abrahams seek an unspecified judgment, plus pre-judgment interest, costs and other relief the court deems just.
