Orange County sued for auto collision

A city of Orange resident is alleging an Orange County employee negligently caused an automobile collision while her daughter was in the car with her.

Individually and on behalf of her minor daughter, April Benoit filed suit against Orange County and Frederick Rains in Orange County District court.

Court records state that on June 6, 2008, Benoit was traveling on Miller Drive when Rains, who was operating a farm tractor, cut into her lane, striking the vehicle and throwing it into a ditch.

Benoit alleges the county employee negligently failed to keep a proper lookout.

The plaintiffs are suing for past and future mental anguish, medical expenses and lost wages, plus all court costs.

They are represented by Edward Chatelain.

The case has been assigned to Judge Dennis Powell, 163rd Judicial District.
