Louisiana resident injured when truck loses load

A Louisiana resident has filed suit against a truck driver and his employer after part of the truck's load fell off and struck her car.

Tammy Lynn Baimbridge filed suit against Matthew H. Bunt and S&M Transport on May 20 in Orange County District Court. The defendant removed the case to the Eastern District of Texas, Beaumont Division on June 18.

The incident occurred on May 20, 2008, when Baimbridge was traveling on Interstate 10 in Orange County. Baimbridge was traveling behind Bunt's 2007 Peterbuilt traditional truck when part of the load fell off and struck the front passenger side of Baimbridge's Ford F-150 pickup.

The defendants are accused of failing to maintain a proper lookout, failing to properly secure its load, and failing to take proper evasive action in order to avoid any portions of its load to fall off.

Baimbridge is seeking damages for medical expenses, loss of earnings, physical impairment, physical pain and mental anguish, interest and costs of suit.

The plaintiff is represented by James Doyle of Lake Charles, La.

U.S. District Judge Ron Clark is assigned to the case.
