A former Target employee has filed suit against the company's ERISA plan, after her claim was refused and benefits denied.
Gail Senegal filed suit against Target Corporation Texas Occupational Injury Benefit Plan on June 21 in the Eastern District of Texas, Beaumont Division.
Senegal claims she has been unable to work since Feb. 24, 2009. She states that the ERISA plan has refused her claim and failed to pay benefits that she is due.
Senegal is not seeking an award for personal injuries or other claims, as those are already pending in a separate lawsuit.
The defendant is accused of breach of contract and violation of its duties under the ERISA plan.
Senegal is seeking an award of actual damages, plus taxable costs, attorney's fees and pre and post-judgment interest.
Beaumont attorney John Werner of Reaud, Morgan & Quinn is representing the plaintiff.
U.S. District Judge Marcia A. Crone is assigned to the case.
