Company sues VISD for subcontractor's nonpayment

Transit Mix Concrete & Material Company has filed suit against the Vidor Independent School District, alleging one of VISD's subcontractors refused to pay its bill.

The suit was filed June 18 in Orange County District Court.

Court records show that Transit sold E&D Contractors $34,031.67 worth of goods. At the time of the purchase, E&D was working for the district on a construction project.

"Pursuant to the Texas Government Code, defendant was required by law to obtain a payment bond from E&D before allowing it to began work," the suit states. "Defendant failed to do so ... and is liable."

Transit is seeking actual damages, interest and court costs.

The company is represented by Beaumont attorney Bill Richey of Griffin & Matthews.

The case has been assigned to Judge Buddy Hahn, 260th Judicial District.
