A Beaumont woman has filed suit against the driver who she claims failed to yield the right-of-way and struck her vehicle.
Yvonne Ritter claims she was driving east on Delaware Street in Beaumont on Aug. 25, 2008, when defendant Elizabeth Rogers suddenly failed to yield the right-of-way and struck her vehicle. At the time of the collision, Elizabeth Rogers was driving a vehicle owned by co-defendant Janet Rogers, according to the complaint.
Because of the collision, Ritter incurred medical costs; experienced extreme physical pain, suffering, mental anguish, disfigurement and physical impairment; and lost earnings and her earning capacity, the suit states.
Elizabeth Rogers negligently failed to maintain a proper lookout, failed to timely apply her brakes and failed to yield the right-of-way, the complaint says. Ritter accuses Janet Rogers of negligent entrustment.
In her complaint, Ritter is seeking an unspecified judgment, plus interest, costs and other relief the court deems just.
The case has been assigned to Judge Bob Wortham, 58th District Court.
