Payment for dirt subject of school construction suit

A trucking company has filed suit against a subcontractor, alleging it was not paid for dirt it provided at a school's construction site.

LSJ Trucking claims defendant Boyette Construction hired it to provide dirt for the West Orange�Cove Independent School District elementary school construction project in Orange.

After providing the dirt, LSJ sent Boyette invoices totaling $48,487.50 for materials it delivered to the work site in November 2008, according to the complaint filed June 30 in Jefferson County District Court.

However, Boyette has still not paid for the materials, the suit states.

LSJ is seeking a judgment for breach of contract, plus pre- and post-judgment interest, attorney's fees, costs and other relief to which it may be entitled.

Bruce Gregory of The Gregory Law Firm in Port Neches will be representing it.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
