Dealership sued after serviced vehicle wrecks

GALVESTON - After a one-vehicle accident last year in which one of them was ejected, two Galveston County residents are suing a local auto dealer.

Keegan Black and Robert Luna's lawsuit against Sand Dollar Autoplex Ltd. states that on April 15, 2009, the 2007 Jeep Liberty in which the plantiffs rode got into a wreck.

Black sustained severe and disabling injuries when she was thrown from the vehicle as it rolled violently out of control, the lawsuit states.

The suit was filed July 8 in Galveston County District Court.

Court papers allege the vehicle was serviced by the defendant on three different occasions within a 12-month period prior to the accident. Chief among the reported problems were the brakes.

The suit faults Sand Dollar for negligence and negligent hiring and management.

Black and Luna seek unspecified monetary damages for pain and suffering, mental anguish, and lost wages as well as a jury trial.

Attorneys Darrell Apffel and S. Benjamin Shabot of Galveston are representing the plaintiffs.

Galveston County 122nd District Court Judge John Ellisor is presiding over the case.
