While exiting the Big Lots in Orange almost two years ago, Mike Feagin claims he tripped over an "uneven concrete surface" and injured his wrist.
Alleging that the discount retailer knew of the "unreasonably dangerous condition," Feagin filed suit against Big Lots on June 28 in Orange County District Court.
According to the suit, on Aug. 9, 2008, Feagin was shopping at Big Lots and as he was exiting the store, "he tripped and fell on the uneven concrete surface located at the entrance."
"The condition of the premises where plaintiff fell posed an unreasonable risk of harm to individuals," the suit states. "As a result,plaintiff sustained ... injuries to his wrist and hand."
Feagin goes on to allege Big Lots owed him a duty to warn him of the dangerous condition.
He is suing for past and future medical expenses, mental anguish and lost wages.
He is represented by Provost Umphrey attorney Douglas Sikes.
The case has been assigned to Judge Dennis Powell, 163rd Judicial District.
