Wal-Mart sued after customer slips and falls

A Wal-Mart shopper has filed a lawsuit after slipping in water and falling.

Annie Helton filed suit against Wal-Mart Stores Texas, doing business as Wal-Mart Super Center, on July 21 in Jefferson County District Court.

The incident occurred on Aug. 23, 2008, at the Wal-Mart in Port Arthur. Helton states the ceiling was clearly leaking and Wal-Mart should have placed "wet floor" signs in the area.

Wal-Mart is accused of negligence for breaching the duty of ordinary care, failing to warn customers of the dangerous condition and failing to reduce or eliminate the risk.

Helton is asking for an award of medical expenses, loss of earnings and earning capacity, physical impairment, physical pain, mental anguish, disfigurement, interest and court costs.

Helton is represented by Beaumont attorney Jonathan C. Juhan.

Judge Bob Wortham,58th District Court, is assigned to the case.

Case No. A187-348
