An Orange County woman has filed suit against the truck drivers she claims caused a multi-car collision with the vehicle in which she was riding.
Mabel Peveto claims she was riding as a passenger in a 2007 Pontiac Torrent being driven west on College Street in Beaumont by her cousin on June 15 at about 8:14 a.m. when the accident occurred.
"Suddenly, and without warning, the 2000 Freightliner truck and token trailer operated by defendant Lynn Beverly struck the Federal Express 2003 Freightliner truck being operated by Defendant Zedric Wayne Savoy, which in turn collided with Plaintiff's vehicle, despite the efforts made by Plaintiff's cousin to avoid the collision," the suit filed Aug. 26 in Jefferson County District Court states.
Because of the collision, Peveto suffered a fracture of her right cervical vertebra and experienced physical pain and mental anguish, according to the complaint. In addition, she suffered physical impairment, incurred medical costs, suffered property damages and experienced a reduced market value of her vehicle, the complaint says.
Peveto blames Beverly for negligently failing to keep a proper lookout, for failing to properly apply his brakes, for failing to maintain control of his vehicle, for driving too fast, for failing to turn to avoid a collision with a Fed Ex truck and for failing to drive within a single lane.
At the time of the collision, Beverly was driving a truck for defendants Robert Charles Denley and R. Denley Enterprises, who are liable because Beverly was working for them, according to the complaint.
Savoy negligently failed to keep a proper lookout, failed to properly apply his brakes, failed to maintain proper control of his vehicle and failed to turn to avoid a collision, the suit states.
In her complaint, Peveto is seeking damages, plus pre- and post-judgment interest, costs and other relief the court deems just.
