Father, daughter claim injuries in collision

GALVESTON - A Montgomery County man has filed suit against a towing company, its owner and one of its employees over an accident two years ago.

In a lawsuit filed Aug. 31 in Galveston County District Court, Eric Price explains that on Sept. 3, 2008, Joseph Kearns, a driver for Quick Tow Inc., sped into his vehicle as he was traveling on the Interstate Highway 45 frontage road in La Marque.

Price was accompanied by his daughter at the time of the alleged collision. He claims that both of them suffered severe injuries.

Court papers fault Kearns for not controlling his speed, not applying his brakes in a timely manner, and not keeping a proper lookout.

They also blame Quick Tow owner Michele Whittington for hiring and retaining Kearns.

Consequently, Price seeks unspecified monetary damages and a jury trial.

Smith & Hassler is representing the plaintiff, and Galveston County 212th District Court Judge Susan Criss is presiding over the case.
