Bartender claims beer bottles not safe, sues bar owner

GALVESTON - After sustaining injuries while working at a Friendswood pub, a Harris County woman has filed suit against her employer.

Krystal Baggerly's lawsuit against Cheers Pub Inc. and bar supervisor Shalimar Arnold claims Baggerly hurt herself on Sept. 16, 2009, as she was organizing beer containers.

The suit was filed Sept. 2 in Galveston County District Court.

Court papers assert that "the beer glass bottles were not inspected to ensure safe handling."

"The defendants' failure to inspect the boxes and keep the plaintiff's work area free of damages amounts to negligence which caused the plaintiff to sustain serious bodily injury," the original petition says.

Though the complaint does not elaborate on the kind of injuries Baggerly incurred, it insists that they were life-threatening and required immediate medical treatment and subsequent, extensive care.

The plaintiff consequently seeks unspecified monetary damages and a jury trial.

She is represented by Smith & Hassler.

The case has been assigned to Galveston County 405th District Court Judge Wayne Mallia.
