Alleging their long-time insurance agent misrepresented their policy, Bruce and Rhonda Gunstream filed suit against Sybil Fortenberry and her employer.
Their suit was filed Aug. 26 in Orange County District Court. Louis A. Williams & Associates is also named as a defendant.
According to the suit, the Gunstreams are longstanding customers of Fortenberry, who has insured their Vidor property since 2005.
Allegedly, Fortenberry informed them they would have wind storm coverage from Dec. 6, 2006, through Dec. 6, 2008, court papers say.
When Hurricane Ike struck on Sept. 13, 2007, the couple submitted a claim and was informed their insurance policy did not provide wind storm coverage.
The Fortenberrys are accusing the defendants of negligent misrepresentation, fraud and violating the Texas Insurance Code.
They are suing for actual and consequential damages, plus all court costs.
Attorney Steve Parkhurst of the Orange law firm Dies & Parkhurst is representing them.
Judge Buddy Hahn, 260th Judicial District, has been assigned to the case.
