Car pulling out of driveway caused crash, suit states

A Port Arthur man has filed suit against the driver who he claims struck the front end of his vehicle as the driver attempted to pull out of a private driveway.

Burt Lemons Jr. claims he was driving in Port Arthur when defendant Garland Jackson failed to control his speed as he pulled out of a private driveway and struck the front end of Lemons' vehicle on June 4.

Because of the collision, Lemons incurred medical costs, sustained severe injuries and experienced extreme physical pain, suffering and mental anguish, according to the complaint filed Sept. 23 in Jefferson County District Court. In addition, he suffered physical impairment, the suit states.

Jackson negligently failed to maintain a proper lookout, failed to come to a stop before hitting Lemons, failed to timely apply his brakes and drove too fast, the complaint says. In addition, Jackson failed to maintain proper control of his vehicle, Lemons says.

In his complaint, Lemons is seeking an unspecified judgment, plus interest, costs and other relief the court deems just.
