Woman sues driver for wreck, insurance company for lack of coverage

A Vidor woman is suing three individuals and an insurance company for an automobile collision she was in two years ago.

Jenny Frazier filed her suit against Kimberly and Beanita Netterville, Jeffrey Powers and Farmers Texas County Mutual Insurance on Sept. 9 in Orange County District Court.

Court papers show that on Oct. 9, 2008, Frazier was traveling westbound on Old Hwy. 90 in Vidor when Kimberly, driving a vehicle owned by Beanita, failed to yield the right of way when turning left and slammed into her.

After the wreck, she submitted a claim to Farmers under her policy for underinsured drivers. Allegedly, Farmers agent Powers denied a portion of her claim.

She is suing Farmers for breach of contract and alleging Kimberly negligently failed to keep a proper lookout.

Frazier is seeking damages for her alleged mental anguish, pain, impairment and lost wages, plus loss of benefits under her policy.

She is represented by Beaumont attorney Jonathan Juhan.

The case he been assigned to Judge Dennis Powell, 163rd Judicial District.
