MARSHALL-A Texas woman has filed a lawsuit against a trucking company after one of its drivers failed to yield at an intersection and plowed into her vehicle.
Elizabeth Gray Chandler filed suit against Acme Truck Line on Sept. 29 in the Eastern District of Texas, Marshall Division.
The accident occurred on July 20 as Chandler was traveling southbound on Harvey Road in Lindale. Chandler states a driver for Acme Truck was traveling on the Interstate 20 off ramp and failed to yield the right-of-way at the stop sign and collided into her vehicle.
The defendant is accused of negligence in failing to control his speed, failing to keep a proper lookout, failing to properly apply his brakes or take proper evasive action and failing to yield the right of way.
The plaintiff is seeking more than $100,000 in damages for physical pain, mental anguish, medical expenses, lost wage earning capacity, severe physical impairment and disfigurement, interest and costs.
Chandler is represented by G.R. Akin of Longview and Keith Miller of Tyler. Jury trial is requested.
U.S. District Judge T. John Ward is assigned to the case.
