Suit filed over crash on MLK

A Port Arthur man has filed suit against the driver who he claims failed to yield the right-of-way at a stop sign and struck the vehicle in which he and his son were riding.

Melvin Maxwell claims he and his minor son, Chrishaun Maxwell, were traveling on Martin Luther King Jr. Boulevard in Beaumont on Nov. 1, 2008, when defendant Richard Stanley slammed into their vehicle after allegedly failing to yield the right-of-way at a stop sign.

Because of the accident, the Maxwells incurred medical costs; lost earnings and their earning capacity; and suffered physical impairment, pain and mental anguish, according to the complaint filed Oct. 7 in Jefferson County District Court. In addition, they incurred property damages while Chrishaun Maxwell suffered from disfigurement, the suit states.

Stanley negligently failed to keep a proper lookout, failed to timely apply his brakes to avoid the collision and failed to proceed through an intersection only when he could safely do so, the complaint says.

In his complaint, Melvin Maxwell is seeking a judgment for unspecified damages, plus interest, costs and other relief the court deems just.

Jonathan C. Juhan of Beaumont will be representing him.

The case has been assigned to Judge Bob Wortham, 58th District Court.
