Auto wreck subject of lawsuit

One Jefferson County and one Harris County resident claim they incurred medical costs after a driver rear-ended the vehicle in which they rode.

Larry Sonnier and Diana Nugent filed a lawsuit Oct. 12 in Jefferson County District Court against Johnny Ray Denison.

The plaintiffs claim they rode in a vehicle traveling south on FM 385 at Hillebrandt Bridge on Oct. 26, 2008, when Denison rear ended their vehicle.

In addition to their medical costs, the plaintiffs experienced physical pain and suffering; lost earnings; and suffered impairment, mental anguish and disfigurement, according to the complaint. They also lost their household services, the suit states.

The plaintiffs blame Denison for causing the collision, saying he negligently failed to keep a proper lookout, drove too fast, failed to timely apply his brakes, failed to turn to avoid a collision, drove inattentively, failed to control his vehicle and failed to yield the right-of-way, the complaint says.

In their complaint, the plaintiffs seek a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus pre-judgment interest at the maximum rate allowed by law, post-judgment interest at the legal rate, costs and other relief the court deems just.

The case has been assigned to Judge Gary Sanderson, 60th District Court.
