Port Arthur resident Roy Allen is suing Stonegate Manor Apartments claiming it failed to provide him with a handicap ramp.
More than a year after tripping on a curb, Allen filed the suit Oct. 27 in Jefferson County District Court.
On March 30, 2009, Allen, a Stonegate Manor resident, was stepping off a curb to get to a handicap transit van when he fell, according to the petition.
The suit does not say whether Allen is handicapped and also does not describe the nature of his injuries.
In his suit, Allen alleges Stonegate Manor negligently failed to warn him of the danger and provide its tenants with a handicap ramp.
"Defendant knew this condition caused an unreasonable risk of harm to persons such as the plaintiff who require handicap accessible areas," the suit states. "Defendant failed to exercise ordinary care to reduce or eliminate this risk."
Allen is suing for his alleged mental anguish, pain, lost wages and medical expenses. He is represented by Beaumont attorney Tom Oxford of the Waldman Smallwood law firm.
Judge Gary Sanderson, 60th District Court, has been assigned to the case.
