GALVESTON - A Texas City church is suing Delta Electronics and Belkin International after a piece of electronic equipment malfunctioned and ignited a fire last year.
In a deceptive trade practice lawsuit filed Oct. 28 in Galveston County District Court, plaintiff St. Johns United Methodist Church explains that it purchased a Belkin Uninterruptible Power Supply Unit manufactured by Delta Electronics on guarantees that the device was safe and fit to use, only to experience a major glitch on Sept. 10, 2009.
"Suddenly and without warning, the Belkin unit experienced a failure which resulted in a fire at the St. Johns premises," the original complaint says.
The church asserts that the unit "was defective and unsafe for its intended purposes at the time it left the control of Delta," and the subsequent blaze caused extensive damage.
Consequently, the plaintiff seeks unspecified monetary damages and a jury trial.
It is represented by Sheiness, Scott, Grossman & Cohn LLP, and the case has been assigned to Galveston County 405th District Court Judge Wayne Mallia.
