Suit claims worker fell through scaffold

Motiva employee Eric Brooks is suing Brand Energy Solutions, claiming he fell through a scaffold the company had erected.

The suit was filed Nov.1 in Jefferson County District Court.

Court papers show that Brooks was working at Motiva's Port Arthur premises on a vessel named the Regen when he fell through scaffolding that had been erected by BES.

In his suit, Brooks claims there were gaps in the scaffold, which BES negligently failed to warn him about.

Brooks further claims BES failed to provide him with a safe working environment, court papers say.

Brooks is suing for past and future mental anguish, pain, medical expenses, impairment, disfigurement and lost wages.

He is represented by Beaumont attorney Dan Ducote Jr. of the Moore Landrey law firm.

Judge Donald Floyd, 172nd District Court, has been assigned to the case.
