Hitchcock school employee sues to recoup crash costs

GALVESTON - After he was involved in a two-vehicle accident four years ago, a Galveston County man seeks to recover compensation from his employer's insurance companies.

Hitchcock Independent School District driver Phillip Parton alleges that Clarendon America Insurance Co. and Old American County Mutual Fire Insurance Co. refused to honor his claim resulting from the Nov. 8, 2006, incident though he promptly and properly reported the losses pursuant to the defendants' policies.

Parton's suit was filed Nov. 5 in Galveston County District Court.

According to court papers, the plaintiff was driving an HISD-owned pickup truck westbound on FM 519 in Hitchcock when another vehicle came into his path from nearby Highway 6 and hit him, causing the truck to roll over.

Parton learned that the other driver was uninsured thus filed a claim under uninsured motorist coverage.

The defendants, however, failed to pay the plaintiff the benefits arising from the claim in question, the suit says.

Attorney Rex A. Frazar of Houston is representing Parton.

The case has been assigned to Galveston County 122nd District Court Judge John Ellisor.
