A Nederland man has filed suit against the driver he claims rear-ended him, causing him to sustain head, neck, ears and body injuries.
Steven Nunez claims he was driving on Nederland Avenue in Jefferson County when defendant Alan J. Cole, who was driving behind him, failed to control his speed and struck the rear of his vehicle.
In addition to his injuries, Nunez incurred medical costs; experienced physical pain, mental anguish, physical impairment and disability; and lost wages, according to the complaint filed Nov. 2 in Jefferson County District Court.
Steven's wife, Tami Nunez, also a plaintiff, claims she lost her husband's affection, solace, comfort, companionship, society, assistance and sexual relations because of the accident.
Cole negligently failed to maintain proper control of his vehicle, failed to timely apply his brakes, failed to take proper evasive action, failed to maintain a proper lookout, failed to use reasonable care, failed to stay alert, followed Steven Nunez's vehicle too closely and failed to maintain a proper distance between his vehicle and Nunez's, the suit states.
In their complaint, the Nunezes are seeking an unspecified judgment, plus interest, costs, exemplary damages and other relief the court deems just.
