A Union Pacific Railroad Co. employee is seeking to obtain a temporary restraining order against his employer to stop the company from investigating a transportation vehicle collision.
UP employee Quirino Villarreal is also seeking to recover more than $50,000 in damages from Professional Transportation, the company involved the crash.
Villarreal filed his petition Nov. 16 in Jefferson County District Court.
Court papers show that on Nov. 5 Villarreal was a passenger in a vehicle operated by Professional Transportation and used to transport UP employees when the motor vehicle collision occurred.
On Nov. 13 he received a letter from UP notifying him that a formal investigation would soon be launched for the purpose of disciplinary action.
In response, Villarreal filed his TRO request three days later, hoping to stop the investigation and stop UP from taking any action against him, court papers say.
Villarreal also listed Professional Transportation as a defendant in the petition and is seeking to recover damages from the company for his alleged mental anguish and medical expenses.
The suit accuses Professional Transportation of negligent entrustment.
Villarreal is represented by Provost Umphrey attorney David Wilson of Beaumont.
The case has been assigned to Judge Bob Wortham, 58th District Court.
