GALVESTON - A Galveston County man has filed suit over a two-vehicle accident on Christmas Day two years ago.
In a lawsuit filed Dec. 3 in Galveston County District Court, Joe M. Harris alleges Michael and Joseph Kacko are responsible for a vehicle that smashed into the back of his 2002 Ford F-150 pickup truck on Dec. 25, 2008, while he was parked.
Court papers do not say which of the defendants was behind the wheel at the time of the alleged incident.
According to the original complaint, Harris was not wearing a seatbelt since the truck was in a parking spot.
"The plaintiff was violently jerked and thrown about the truck as a result of the collision," it says.
"The collision proximately called caused injuries and damages to the plaintiff."
The suit faults the presumed motorist for not controlling their speed and failing to brake in a timely manner.
Consequently, Harris seeks unspecified monetary damages and a jury trial.
He is represented by attorney M. Andrew Seerden of Houston.
The case has been assigned to Galveston County 122nd District Court Judge John Ellisor.
