AT&T files loss of business suit over damaged lines

AT&T is suing W.W. Webber claiming the construction company damaged its underground facilities while excavating.

The suit was filed Nov. 29 in Orange County District Court.

In its suit, At&T says it is an utility company providing telecommunication services and has many underground facilities throughout Southeast Texas to provide service.

AT&T claims Webber damaged some of its facilities while excavating, putting public safety in jeopardy and causing costly damage.

The suit does not give dates when the damage occurred, but does negligently accuse Webber of not inquiring where the telephone facilities were before excavating.

AT&T is suing for actual and consequential damages.

The company is represented by attorney Kevin Wiggins of the Dallas law firm Yoss White & Wiggins.

Judge Dennis Powell, 163rd District Court, has been assigned to the case.
