Fall in Dickinson parking lot leads to lawsuit

GALVESTON - After hurting herself in a Dickinson parking lot, a Huntsville woman has filed suit against the premises owners, Dixie Partners II LP and Big D Properties Inc.

Rita Ghirardi blames her bodily injuries on a defect in the aforementioned parking lot, according to a lawsuit filed Dec. 15 in Galveston County District Court.

Though the original petition is mum on the exact circumstances of the alleged May 13, 2009, incident, it shows that "the defect in the parking lot pavement constituted a dangerous condition" and Ghirardi "did or failed to do, caused, or contributed to cause the occurrence."

The defendants are faulted for improper maintenance and operation as well as a failure to warn the plaintiff and the public about any potential dangers in the parking lot, the suit says.

Consequently, Ghirardi seeks more than $10,000 in damages.

She is represented by attorney Bennie D. Rush of Huntsville.

Galveston County 122nd District Court Judge John Ellisor is presiding over the case.
