Rear end collision at traffic light results in lawsuit

Nederland resident John James claims fellow Nederland resident Kevin Frasier rear ended him while stopped at a traffic light last January.

Alleging Frasier failed to keep a proper lookout and apply his braked in time, James filed suit against him Dec. 21 in Jefferson County District Court.

Court papers show that on Jan. 11, 2009, James was traveling on FM 366 in Nederland. He was stopped at a traffic light when "Frasier failed to control his speed and slammed" into him."

The suit does not state if the traffic light was red at the time of the incident.

Since the incident, James claims to suffer from headaches with pain injury to his neck, ribs, chest and back.

James is suing for his alleged past and future mental anguish, impairment, medical expenses and pain.

The plaintiff is represented by Beaumont attorney Jonathan Juhan.

Judge Bob Wortham, 58th District Court, has been assigned to the case.
