A Nederland man has filed suit against the driver who he claims rear-ended his vehicle, causing him to sustain injuries to his neck, back and body.
Kenneth Bracken claims he was driving north on 5500 West Cardinal Drive in Beaumont on Jan. 26, 2009, when defendant Cathy Collins, who was driving in the same direction, struck the rear of his vehicle.
Because of the collision, Bracken incurred medical costs and experienced physical pain, suffering and physical impairment, according to the complaint filed Dec. 22 in Jefferson County District Court.
Collins negligently failed to timely apply her brakes, failed to maintain a proper lookout, failed to drive in a safe manner, failed to maintain control of her vehicle and failed to take evasive action, the suit states. In addition, she failed to drive in a single lane and failed to maintain a safe distance between her vehicle and Bracken's, the complaint says.
In his complaint, Bracken is seeking a judgment within the jurisdictional limits of Jefferson County District Court, plus pre-judgment interest at the maximum rate allowed by law, post-judgement interest at the legal rate, costs and other relief the court deems just.
