GALVESTON � Alleging Main Street Builders failed to repair their Santa Fe home, Troy and Donna Stuart have filed suit against the business and its owner.
The Stuarts paid the defendants, including David Webber, in July 2009 to perform work at their residence, but Webber did not complete the project as represented and warranted, the lawsuit filed Jan. 4 in Galveston County District Court says.
The original complaint also asserts that the defendants' work was faulty and not performed in a workmanlike manner.
"Further, the defendants' work failed to meet acceptable construction standards or quality," the suit says.
"The plaintiffs did not receive what they bargained for and were victims of false, misleading and deceptive business practices, unconscionable conduct and misrepresentations."
Webber and the company are ultimately guilty of breach of contract and warranty, fraud and negligence.
Consequently, the plaintiffs seek unspecified monetary damages.
They are represented by attorney Michael G. Martinez of Friendswood.
Galveston County 405th District Court Judge Wayne Mallia is presiding over the case.
