GALVESTON – After injuring herself at a La Marque Wal-Mart two years ago, Barbara A. Jones is suing the discount retailer.
Jones claims she slipped on a puddle of water near a plant display by the entrance of the defendant's store on Jan. 6, 2009, and hurt her back.
According to the lawsuit filed Jan. 5 in Galveston County District Court, the plaintiff alleges that the puddle was there for a long time and the defendant failed to remove it.
She blames the store for not properly inspecting and maintaining the area in reasonably good condition, not providing adequate and understandable warnings and not discovering the reportedly dangerous substance in time.
Because of the fall, Jones suffered physical pain and suffering, mental anguish, impairment, disfigurement and lost wages, the complaint says.
She consequently seeks unspecified monetary damages and a jury trial.
Attorney John R. Fabry is representing the plaintiff, and Galveston County 56th District Court Judge Lonnie Cox is presiding over the litigation.
