Pedestrian claims motorist hit her at H-E-B crosswalk

Nederland resident Linda Dubose has filed suit against Orange local Motchen Hayes, claiming he struck her with his car at an H-E-B crosswalk

The suit was filed Jan.10 in Jefferson County District Court.

Court papers show that on Dec. 17, 2009, Dubose was walking across the the crosswalk at the Port Arthur H-E-B when Hayes struck her with his vehicle.

The suit accuses Hayes of negligently failing to keep a proper lookout, apply his brakes and yield to pedestrians.

The suit fails to describe Dubose's alleged injuries.

She is suing for her alleged past and future mental anguish, medical expenses, impairment and lost wages.

Attorney Tom Oxford of the Beaumont law firm Waldman Smallwood is representing her.

Judge Milton Shuffield, 136th District Court, has been assigned to the case.
