GALVESTON - Aurora Leal of League City has filed suit against Texas Farmers Insurance Co. over unpaid fire damages.
According to her lawsuit filed Jan. 10 in Galveston County District Court, plaintiff Leal filed a claim after a blaze severely damaged her home on Dec. 3, 2008.
She argues that the insurer failed to comply with the policy, the Texas Insurance Code and Texas law in handling her claim.
"The defendant has refused to pay all amounts due and owing under the policy for the claim," the original petition says.
It insists that Leal "has complied with any and all of her obligations under the policy."
Farmers is faulted for six counts of alleged wrongdoing, including breach of contract and unfair settlement practices.
Consequently, Leal seeks unspecified monetary damages and a jury trial.
Clark, Burnett, Love & Lee G.P. is representing the plaintiff.
The case has been assigned to Galveston County 212th District Court Judge Susan Criss.
