Plaintiff Joseph Gonzalez has filed a second amended petition in his suit against Sutherlands Lumber.
In both petitions, Gonzalez claims he cut his hand on a piece of glass after employees failed to properly wrap it up.
Court records show he was shopping at defendant Sutherlands Lumber on College Street in Beaumont on Nov. 27, 2007, where he purchased a piece of glass that he had ordered.
An employee cut the glass for Gonzalez but failed to properly wrap and secure the piece of glass, causing Gonzalez to be cut by it.
The second amended petition was filed Dec. 16 in Jefferson County District Court and specifies additional acts of negligence.
Gonzalez alleges the lumber store and its employees failed to wrap and secure the glass, assist him to his vehicle, warn him and other customers and take proper precautions to protect him.
Because of the incident, Gonzalez incurred medical costs, experienced physical pain, suffering, impairment, mental anguish and disfigurement and lost his earnings and earning capacity, the suit states.
